dc.description.abstractIn this study, the relationship between artifact theories and legal theories will be examined with a focus on legal positivism and natural law theory. Particularly, the question of what conclusions can be drawn from the similarities and differences between the ontological artifact theories and legal theories regarding the degree the latter theories are successful in elucidating “law” will be inquired. It will be argued that while legal positivism parallels with artifact theories regarding theoretical presuppositions, natural law theory is better suited to elucidating law’s nature, since “function and intention” plays a role in its explanations in line with artifact theories.en_US
dc.description.abstractBu çalışmada, yapay olgu teorilerinin hukuk teorileriyle olan ilişkisi hukuki pozitivizm ve doğal hukuk teorisi özelinde incelenecektir. Özel olarak araştırılacak soru, yapay olguların ontolojisine dair teorilerin, hukuki pozitivizm ve doğal hukuk teorileriyle benzeşen ve farklılaşan yönlerinden bu sonraki tür teoriler bakımından inceleme konusu edindikleri “hukuk”u açıklamada yeterlilik/eksiklik gösterdikleri yönünde çıkarılabilecek sonuçların ne olduğudur. Bu bağlamda, hukuki pozitivizmin teorik varsayımları yönüyle yapay olgu teorileriyle paralellik arz ettiği, doğal hukuk teorisinin ise bu teorilerce öngörülen “niyet ve fonksiyon” öğelerine açıklamalarında yer verdiğinden hukukun doğasını açıklamaya daha elverişli olduğu ileri sürülecektir.en_US
