Silahlı İnsansız Hava Araçları Kullanılarak Gerçekleştirilen Ulus-aşırı Silahlı Çatışmalarda Devletin Hukuki Sorumluluğu

Abstract

In this thesis, a state's responsibility for operations outside its own country using Armed Unmanned Aerial Vehicles during transnational armed conflicts is examined. In this context, firstly, the emergence of Armed Unmanned Aerial Vehicles, the factors that caused them to be included in the literature, and the place of these vehicles within the study's scope was expressed. The study's primary focus is the use of Armed Unmanned Aerial Vehicles within the scope of the new type of armed conflict that is conceptualized as "transnational armed conflict" and found in international law, and the legal problems arising from this use by states. These problems are examined in the study around the concept of "responsibility" as a branch of international law. Therefore, the study, which is predominantly normative, what the subject means in terms of "responsibility" in international law, the bases of the responsibility, the circumstances revealing the responsibility, the circumstances precluding the responsibility, and the reparation are explained. On the other hand, in the phenomenal aspect, the Armed Unmanned Aerial Vehicle operations carried out by the USA in Afghanistan, Pakistan, and Yemen between 2001 and 2019 were discussed as case studies. The results of the case studies in these countries in terms of "responsibility" have been analyzed. Thus, it was attempted to determine how the normative regulations correspond to concrete events. The findings were presented as conclusions of the thesis in the last part of the study.

Bu tezde, ulus-aşırı silahlı çatışmalar sırasında bir devletin Silahlı İnsansız Hava Araçlarını kullanarak kendi ülke sınırları dışında gerçekleştirdiği operasyonlar nedeniyle hukuki sorumluluğu konusu incelenmiştir. Bu çerçevede, çalışmada öncelikle Silahlı İnsansız Hava Araçlarının ortaya çıkışı, literatürde yer bulmasına neden olan unsurlar ve bu araçların çalışma kapsamındaki yeri ifade edilmiştir. Çalışmanın odaklandığı ana nokta, Silahlı İnsansız Hava Araçlarının devletler tarafından ulus-aşırı silahlı çatışma olarak kavramsallaştırılan ve uluslararası hukukta yer bulan yeni silahlı çatışma türü kapsamında kullanımı ve bu kullanımın hukuksal açıdan ortaya çıkardığı sorunlardır. Bu sorunlar ise çalışmada uluslararası hukukun bir alanı olarak "sorumluluk" kavramı etrafında incelenmiştir. Dolayısıyla, normatif yönü ağırlıklı olan çalışmada, konunun uluslararası hukuktaki "sorumluluk" açısından ne ifade ettiği, sorumluluğun şartları, sorumluluğu ortaya çıkaran nedenler, sorumluluğu kaldıran nedenler ve telafi yolları açıklanmıştır. Olgusal boyutta ise ABD'nin 2001 ve 2019 yılları arasında Afganistan, Pakistan ve Yemen'de gerçekleştirdiği Silahlı İnsansız Hava Aracı operasyonları ele alınmıştır. Bu ülkelerdeki somut olay incelemelerinin "sorumluluk" açısından ortaya çıkardığı sonuçlar tahlil edilmiştir. Böylece, normatif düzenlemelerin somut olaylarda nasıl karşılık bulduğu tespit edilmeye çalışılıp, bulgular çalışmanın sonuç bölümünde tezin vargıları olarak ortaya konulmuştur.
