Title: Avrupa birliği'nde topluluk patenti sürecinde yaşanan sorunlar

Abstract: Ticaretin küreselleşmesiyle patent belgesinin sağladığı korumanın geniş bölgelere yayılması ihtiyacı ortaya çıkmış, patent hakkının ülkesel niteliğinin sakıncalarını bertaraf etmeye yönelik çalışmalar başlamıştır. PCT ve 1P5 gibi küresel gelişmelerin yanı sıra, Avrupa Birliği'nde de patentin verilmesi ve patentten doğabilecek uyuşmazlıkların çözüme kavuşturulması hususunda yeknesaklaştıımayı sağlamak için '"Avrupa patenti" ve "Topluluk patenti" fikirleri ortaya atılmıştır. Heine kadar ulusal patentler demeti olan Avrupa patenti başarıya ulaşmışça da, bu sistem Birlik içinde patent hukukunu uyıımlaştırmaya yetmemiş; daha ileri bir adım olan Topluluk patenti ise Birlik içindeki görüş anlaşmazlıkları sebebiyle hayata geçirilememiştir. Çalışmada Avrupa Birliği'nde patent hukukunun yeknesakkıştı-rıİmasına ilişkin girişimler ele alınmıştır.
Due to globalisation of commerce, the need to extend protection provided by patents has arisen and attempts to eliminate the disadvantages of territorial effects of letters patent have begun. Besides global developments^such as PCT and IP5, for creating a uniofrm patent grant procedure and resolving legal issues in European Union, "European patent'' and "Community patent" ideas have been created. Despite the success of the European patent which is a bundle of national patents, it was not possiple to harmonise patent law and Community patent, which is a further step, because of a lack of concensus of EU Members. In this paper the attempt to create uniform patent law in the EU is discussed.
